The Whereboutz service is brought to you by TeleNav, Inc. (“TeleNav”). TeleNav understands and respects your concerns about the use of your personal information. We believe that you should know what information about you we collect, as well as how that information is used, maintained, and, in some cases, shared. The following sets forth our privacy practices and policies with respect to the Whereboutz service.
(This privacy policy concerns only information that TeleNav collects through the Whereboutz service and not information that TeleNav may collect through other TeleNav services to which you may subscribe. Please consult the separate privacy policy applicable to any such other service to determine how TeleNav treats information collected through that service.)
TeleNav will collect information about you when you do any of the following: (i) download the application for the Whereboutz service; (ii) use the Whereboutz service via your wireless device or Facebook account; (iii) use our www.whereboutz.com website; (iv) participate in one of our promotions, such as a sweepstakes; or (v) request information about the Whereboutz service from us. By doing any of the foregoing, you assent to this privacy policy. If you do not agree with the terms of this policy, please do not engage in any of these activities.
Please be aware that any location and activity information that you voluntarily post to the Whereboutz application becomes immediately available to members of your Facebook social network who have the Whereboutz service, and can be read, collected, and used by such members of your network, and thus could be used to send unsolicited messages to you or track your whereabouts.
As described in greater detail below, we will store and use information about you, including information about who you are, where you disclose that you are located at particular points in time, and where and when you browse on our website, to provide the Whereboutz service to you and to continually improve the quality of the service and this website.
We will not sell or disclose to unaffiliated third parties without your consent your location, activity, and usage information that we collect during your use of the Whereboutz service, except as otherwise provided in this policy. However, we may use such information for targeted advertising and other marketing purposes. In addition, from time to time we will disclose, and may sell, to unaffiliated third parties other information that we collect about you, including information that we collect through your registration to be a user of the Whereboutz service, your participation in one of our promotions, or your request for information about the service.
The following describes the types of personal and other information we may collect about you, and how we use and maintain that information:
We collect your name and 10-digit mobile phone number when you register to become a user of the Whereboutz service , and when you otherwise transmit such information to us via our website or by email, for our use in maintaining your account. We store this information indefinitely in a database.
We also collect from Facebook information regarding your Facebook profile that we store indefinitely, including your name, User ID and Group ID. We use this Facebook profile information to provide the Whereboutz service to you and the members of your social network on Facebook.
Although we do not require that you provide us with your email address, if you do, we will use it to contact you with regard to your relationship with TeleNav, such as to confirm any change to your phone number linked to your Whereboutz account, and to respond to any inquiry you submit via our website or by email. We also may use your email address from time to time to inform you about our products and services that we think will interest you.
Once you register to use the Whereboutz service on your wireless device, we use your 10-digit mobile phone number as your account number so that when you access the Whereboutz service or interact with our automated voice entry system we can use caller ID to map your phone number to your account number.
The Whereboutz service enables you to post your location and activities repeatedly throughout the day via your wireless device or Facebook account. Such information will be distributed immediately to members of your Facebook social network who have the Whereboutz service. Each time that you post your location and activities, we record this information. We also record the same type of information posted by other individuals designated in your Facebook social network, but only for individuals who also have the Whereboutz service.
In addition, each time you access the Whereboutz service with your wireless device or your computer, whether or not you post location and activity information, we use browser cookies and other technologies to collect other information about you, such as your usage patterns. This information is analyzed and may be combined with the usage patterns of other users.
We maintain databases with all of the location, activity, and usage information that we collect, and may keep this information indefinitely.
We use this information to deliver the Whereboutz service and improve your user experience, as well as for determining where we should emphasize improving our coverage and service capabilities. We may also use such information for targeted advertising and other marketing purposes.
In addition, the Whereboutz service includes a “nudge” feature that enables you to request that members of your social network with the Whereboutz service post their location and activity information. These “nudge” messages are transmitted via text messages using Short Messaging Service (SMS). We record these messages, and may keep such information indefinitely.
Our www.whereboutz.com website also employs browser cookies and other technologies to collect other information about visitors to the site, such as their IP address, the type of browsers used, web pages viewed, and other information. This aggregate information is analyzed and may be combined with similar aggregate information of other website visitors.
Visitors may set their browser to reject cookies; however, this may affect some functions of our website.
We may share aggregate information with our business partners and other third parties.
We collect information you give us when you participate in a TeleNav promotion, such as a sweepstakes. Specifically, you will typically be asked to provide your name and email address, and possibly other information such as your mailing address and telephone number.
We store this information in our database and will use it to communicate with you about the promotion. We may also use this information to promote our services to you in the future, unless you inform us that you opt out from receiving such communications.
We also collect information that you give us when you request additional information about the Whereboutz service.
Information we collect through these requests includes your name, phone number, and email address. We will use this information to provide you with details about the Whereboutz service, and we may use this information to promote our services to you in the future, unless you inform us that you opt out from receiving such communications.
We may retain any data you provide to us in an email inquiry, for the purpose of tracking the types of questions we receive.
We may disclose to unaffiliated third parties without your consent personally identifiable information about you that we collect, including information that we collect through your registration to become a user of the Whereboutz service, through one of our promotions, or through your request to us or one of our partners for details about our services. Such third parties may use this information (including your name and phone number) to promote their products and services to you.
We provide non-personally-identifiable, aggregated location, activity, and usage information of Whereboutz users to interested third-parties to assist those parties in understanding the location and activity patterns of our users for targeted advertising and other marketing purposes.
We will comply with any subpoenas, court orders or other legal processes for any of the information about you in our possession, and we may use such information to establish or exercise our legal rights, or to defend against legal claims.
Information about you in our possession may be disclosed as part of any merger, acquisition, sale of company assets, or transition of service to another provider, as well as in the unlikely event of insolvency, bankruptcy, or receivership in which your personal information would be transferred as one of the business assets of the company. TeleNav does not guarantee that any entity receiving such information in connection with one of these transactions will comply with all terms of this policy.
Information that we collect about you may also be transferred among our various divisions and affiliated companies around the world, which may involve transfer from countries within the European Economic Area (EEA) to countries outside the EEA. By allowing TeleNav to collect this information about you, you consent to these transfers, including transborder transmission of data covered by this privacy policy.
We do not knowingly collect or maintain personally identifiable information via the Whereboutz service from persons under 13 years old, and no part of the Whereboutz service is directed to persons under 13. In fact, you need to have a Facebook account in order to use the Whereboutz service, and at this time Facebook does not allow children under 13 to have Facebook accounts. IF YOU ARE UNDER 13 YEARS OF AGE, PLEASE DO NOT USE OR ACCESS THE WHEREBOUTZ SERVICE AT ANY TIME OR IN ANY MANNER. If TeleNav learns that personally identifiable information of persons less than 13 years old has been collected without verifiable parental consent, then TeleNav will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under the age of 13 has obtained a Whereboutz account, then you may alert TeleNav at whereboutz.support@telenav.com and request that we delete that child’s personal information from our systems.
The Whereboutz software (and any upgrades, modifications, or additions thereto) that is downloaded to, and resides upon your wireless device retains your manually entered access code, or reads it from the device. Having your carrier change the assigned phone number for your wireless device does not change the access code that we maintain with regard to that device, which will result in your device not being able to access your Whereboutz account established using the previous phone number. If this happens, please contact TeleNav.
For your convenience, the Whereboutz service and our www.whereboutz.com website contain links to other websites, including some websites administered by other companies on behalf of TeleNav, as well as to websites unrelated to TeleNav (such as Facebook). This privacy policy does not apply to these linked websites operated by third parties. Each website should be checked for its own privacy policy.
TeleNav may from time to time update this privacy policy. In the event that TeleNav merges with, or is acquired by another company, a change to this privacy policy may result. Whenever a change to this policy is significant, we will place a prominent notice on this website.
By choosing to visit this website or otherwise provide information to TeleNav, you agree that any dispute over privacy or the terms contained in this privacy policy will be governed by the law of the State of California. You also agree to arbitrate such disputes and to abide by any limitation on damages contained in our Website Terms of Use, Terms and Conditions of Service, or other agreement we have with you.
If you would like to update or correct any information that you have provided to TeleNav through your use of the Whereboutz service or our websites, or you have suggestions for improving this privacy policy, please send an e-mail to whereboutz.support@telenav.com.
This privacy policy is effective as of November 3, 2007.
