1. Who Can Enter: Any Whereboutz user who has created an account on the Whereboutz.com website and is an active user during the sweepstakes period, as defined below. Must be a legal resident of the 50 United States and the District of Columbia and Canada who has reached the age of majority in his/her state or province of residence at time of entry. Employees, officers and directors of TeleNav, Inc. ("TeleNav"), its affiliates, subsidiaries, and members of their immediate families or of their households, are not eligible.
2. How to Enter: Survey panelists obtain one entry for completing two surveys by July 9, 2010. Only one entry per household and per e-mail address is accepted; duplicate surveys or other entries for a household or an e-mail address are eliminated or disqualified. Entries become the property of TeleNav and will not be returned. If there is a dispute as to the identity of an online entrant, the prize will be awarded to the authorized account holder of the e-mail address. The "authorized account holder" is defined as the natural person to whom the e-mail address is assigned by an Internet service provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
3. Sweepstakes Dates: The sweepstakes period will begin on May 10, 2010 and will close by June 30, 2010 at 11:59 PM Pacific time. Surveys will be sent via a survey link by e-mail. The first survey will e-mailed to the survey panelist on May 31, 2010 and the second survey will be e-mailed on June 30, 2010. Each survey must be completed within five (5) days of the date the survey was e-mailed. Any survey panelist who has completed and returned the two surveys within the requisite period by July 9, 2010 will be eligible to participate in the sweepstakes.
4. Prizes: One (1) $500.00 VISA Gift Card. The total retail value of the sweepstakes prize is US$500.00.
5. Prize Drawings: A winner will be selected at random by TeleNav based on completed surveys received by July 9, 2010. The prize drawing for the sweepstakes will be held on or around July 12, 2010.
6. Odds of Winning: Each entrant's odds of winning are dependent on the number of eligible entries received.
7. Conditions of Participation: All survey panelists must have a valid e-mail address, and it is the survey panelist's responsibility to update TeleNav of any change in e-mail address. No transfer, assignment, or substitution of a prize permitted. All federal, state, provincial, and local laws and regulations apply. Survey panelists agree to be bound by the terms of these Official Sweepstakes Rules and by the decisions of TeleNav, which are final and binding on all matters pertaining to this sweepstakes. All survey panelists may be required to sign any documents necessary to transfer copyright of the entry to TeleNav within seven (7) days following the date of first attempted notification. Submission of an entry constitutes permission for TeleNav and its agencies to use the survey panelist’s name and/or likeness, biographical material, and/or entry (including an altered form of the entry) for advertising and promotional purposes without additional compensation, unless prohibited by law.
A survey panelist will not give feedback that is subject to license terms that seek to require any TeleNav product, technology, service or documentation incorporating or derived from such feedback, or any TeleNav intellectual property, to be licensed or otherwise shared with any third party. Furthermore, unless provided in a separate subsequent written agreement between the parties, TeleNav shall be free to use, disclose, reproduce, license or otherwise distribute, and exploit the any feedback provided to it as it sees fit, entirely without obligation or restriction of any kind on account of intellectual property rights or otherwise.
8. Internet: TeleNav is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by TeleNav on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. TeleNav reserves the right at its sole discretion to cancel, terminate, modify, or suspend the sweepstakes. Any attempt by a survey panelist to deliberately damage any website or undermine the legitimate operation of the sweepstakes is a violation of criminal and civil laws and should such an attempt be made, TeleNav reserves the right to seek damages from any such participant to the fullest extent of the law.
9. Winner Notification: The winner will be notified via e-mail within 24 hours of the prize drawing (on or about July 13, 2010). The winner will be required to respond to the e-mail to acknowledge receipt of the prize. The winner may decline the prize. If no response is obtained from the winner by July 16, 2010, or the prize is declined, the prize will be awarded to a replacement winner drawn at random. TeleNav’s decisions about the winner(s) are final. The prize will be awarded.
10. Limits of Liability: Except where prohibited, each survey panelist agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this sweepstakes or the prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Santa Clara, California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; (3) no punitive, incidental, special, consequential, or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"); and (4) survey panelist hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. California state law, without reference to California's choice of law rules, governs the sweepstakes and all aspects related thereto.
11. Winner Responsibilities: The winner is solely responsible for the reporting and payment of any tax liabilities incurred. The winner must submit an affidavit of eligibility and compliance with the Official Sweepstakes Rules.
12. Winner Publicity: TeleNav may wish to publish the first name, first letter of last name, and location (city/state) of the winner, and any quotation that the winner is willing to provide on the panelist website. However, TeleNav stands by its commitments of confidentiality and will request written permission from each panelist prior to publicizing any names on the website.
